Rules and Regulations
Rules and regulations in respect of Treeferns Trout Lodge
1. These are the Rules referred to and as laid down by the registered Owners of the Lodge.
2. All guests undertake that they shall be bound by the Rules as set out herein, and which have been established to control and administer access to and use and enjoyment of the Property, the Premises and Facilities, and guests shall furthermore ensure that all persons invited, and using or enjoying access to the Property and/or accommodation in the leased Premises, shall similarly comply with these Rules.
3. All guests shall accordingly:
3.1 not make any undue noise or create any nuisance or disturbance on or about the Property or Premises or accesses/roads thereto;
3.2 not make any new roads and only drive on clearly defined roads;
3.3 prevent and avoid any form of pollution of the environment (including the water table);
3.4 not feed fauna;
3.5.1 not make fire in any place other than as specifically designed therefore;
3.5.2 take steps to ensure any fire so make does not spread;
3.5.3 prevent veld fires;
3.6 not bring onto the Property any caravan or mobile home;
3.7 not erect any tent or other form of camp on the Property;
3.8 not exceed the speed limit of 30 (Thirty) kilomotres per hour on or about the Property;
3.9 not collect or remove any wood, stones, flora, fauna or fauna remains;
3.10 not remove and/or collect wood for purposes of fire (firewood will be made available at designated places on the Property);
3.11 not bring any motorcycle onto the Property;
3.12 respect all signs, notices and warnings;
3.13 not use a lamp or other form of illumination when driving at night, save as specifically directed or permitted;
3.14 ensure that all refuse is correctly placed in the bins or other holders provided (and care must be taken where indicated to separate glass, plastic and the like for purposes of recycling);
3.15 avoid littering at all times;
3.16 not interfere with the staff employed in and about the Property;
3.17 ensure that proper care is taken of all keys and a charge will be levied for any lost key (or key which is not duly returned);
3.18 ensure the maintenance of good and orderly conduct for purposes of good neighbourliness;
3.19 avoid using or abusing alcohol in a manner as causes any nuisance to the other occupiers, staff and the like;
3.20 not use any radio’s, CD players, TV’s and the like where same causes a nuisance;
3.21 ensure when using facilities, that same are maintained in a good, sound and hygienic condition, and a charge will be levied for any loss or breakage;
3.22 report promptly to management any problems;
3.23 ensure that no animals or pets may be brought onto the Property;
4. The Owners shall be entitled to promulgate and otherwise make known such Rules and regulations concerning access to and traversing of the farm, use of the Facilities, conduct in and about the Property and the like, and as shall be additional, supplementary to and/or in replacement of any of these Rules, and all of which such further Rules shall have the same binding effect as if contained herein.
5. The decision of the Owners with regard to the control, administration and supervision of the Property and Premises, as to whether any “nuisance” or “disturbance” is created or caused, shall be final and binding upon all persons.
6. The Owners reserve the right on good cause to restrict and/or refuse admission to the Property to any person who is under the influence of alcohol and/or and other form of narcotic, and as a result, in the discretion of the Owners’ said staff, a nuisance or disturbance is caused and/or the peaceful use and enjoyment of the Property and Facilities is otherwise jeopardised, and the rights of the Owners shall extend , in such circumstances, to the eviction of such offender from the Property.
7. The register for fishing must be completed and all fish caught whether released or not, must be recorded in the said register.
8. Catch and release is allowed, subject to the Rules as prescribed in the fish register.
9. All gates must be closed at all times.
10. All guests be that in their personal capacity, or as parents, guardians or legal custodians of any minor children by their signature of the register, hereby indemnify the Owners, employees or agents against any responsibility or liability for any loss or damage to the Property, or for any personal injury, other harm or death which may befall any person whilst in, or about the Property or any facility pertaining thereto and howsoever arising and/or as may occur in respect of any activities conducted on or from the Property and furthermore indemnify the Owners, employees or agents in respect of all or any claims howsoever and whensoever arising and as referred to above, and further shall take cognisance of all notices posted in or about the Property and accept on behalf of all minor children all risks attendant upon being in or on the Property and/or using any facilities thereon or therefrom. This Indemnity/Waiver shall apply in respect of all visits by any guest as aforementioned to the Property and whether in a group of otherwise.
11. The Rules and Indemnity form part of the register which must be signed on arrival and signature of the register shall be regarded as an acceptance of the Rules as set out herein.
